CHIPPEWA TOWNSHIP, WAYNE COUNTY, OHIO
RESOLUTION 06-0112-08

Motion by Trustee Earl Kerr; seconded by Trustee Jeff Prebish
WHEREAS, pursuant to Chapter 519 of the Revised Code, the Board of Trustees has
the authority to set reasonable fees for zoning permits, zoning certificates, and hearings
before the Zoning Commission and Board of Zoning Appeals; and

WHEREAS, it has come to the attention of the Board of Trustees that the zoning 
authorities have increasingly been faced with situations where the applicants have 
already begun construction of the structure upon which they seek a zoning certificate, a
Board of Zoning Appeals' variance, conditional use or appeal, and/or a rezoning; and

WHEREAS, it is much more expensive for the Board of Zoning Appeals, Zoning Commission 
and Zoning Inspector to properly review those situations in which the structure has already been
fully or partially constructed.

         NOW, THEREFORE, BE IT RESOLVED THAT:

         1.       The fees for zoning permits, Board of Zoning Appeals' hearings
                   and Zoning Commission rezonings shall be doubled in those
                   situations where the Zoning Inspector determines that the
                   applicant has already commenced construction of the
                   structure upon which they seek a permit, zoning variance,
                   conditional use, appeal or rezoning.
         
         2.      The Board finds that these are rationally and reasonably 
                   related to the extra costs added for the extra time and
                   expense of the zoning authorities in dealing with those
                   situations where the applicant has violated the zoning
                   resolution by commencing construction on a structure,
                   and only then seeking to comply with zoning resolution.
